The Court of Appeal has adopted
new Civil Practice
Regulations which came into
force on January 14, 2016. Of note are Rules 27 and 59 that limit
all Notices of Appeal / Demandes d'appel (formerly the inscription in appeal)
and all “Applications in the Course of a Proceeding” / “Demandes en cours
d'instance” (Motions) to 10
pages.
We understand that the Court of
Appeal has taken the position that this covers all applications / demandes that are made to the Court, including Applications
for Leave to Appeal. The
page limit includes the conclusions to the notice or application, even if they
are lengthy. The Court has refused filings that exceed 10 pages.
Those waiting until the last day
to file should be particularly vigilant regarding these new Regulations, since
article 353 of the new Code of Civil
Procedure specifies that
“[T]he time limits for appeal are strict time limits, and the right to appeal
is forfeited on their expiry.”
